MOCO Purchase Terms

P.1 Scope

These terms apply to every purchase of MOCO on the Service, including purchases of the MOCO and Contribution Tower package described below (each, a "Purchase"). They supplement the Terms of Service. If these terms conflict with the Terms of Service on a matter relating to Purchases, these terms control.

P.2 Definitions

"MOCO" means the virtual item made available on the Service for use within the Service. "Contribution Tower" means the real-time display on the Service that records user contributions. "Package" means the bundled product sold in each Purchase, as described in P.4. "Wallet" means the account balance in which a user's MOCO is held.

P.3 Nature of MOCO

MOCO is a limited, revocable, non-transferable (except through Transfers permitted under Section X), non-sublicensable license to use a virtual item within the Service. MOCO is not currency, legal tender, a deposit, or a bank or stored-value account. It is not insured by the FDIC or any other agency, earns no interest, and has no value outside the Service. Purchased MOCO cannot be redeemed, withdrawn, or exchanged for cash, except where required by applicable law or expressly stated in these terms.

P.4 The Package

Every Purchase is a Package that combines (a) a credit of MOCO to your Wallet and (b) a real-time Contribution Tower registration service. When your payment is successfully completed, your MOCO is credited and your user information is recorded on the Contribution Tower in real time. The Package is therefore delivered in full at the moment of payment, regardless of whether or when you use the MOCO. The price of the Package is not separable into a MOCO portion and a Contribution Tower portion.

P.5 Eligibility and Authorization

Only users who are at least 18 years old and have provided an accurate date of birth may make a Purchase. You must be the authorized holder of the payment method you use. You may not use another person's payment method without their permission. Misrepresenting your age or your authority to use a payment method is a violation of these terms.

P.6 Pricing, Payment, and Taxes

Prices are displayed in U.S. dollars at checkout. Payments are processed by Stripe and are subject to Stripe's terms. Prices may exclude applicable taxes, which will be added at checkout where required. We may correct obvious pricing errors and cancel and refund affected orders.

When you purchase MOCO, Stripe payment-processing (PG) fees may be charged in addition to the face value ($5 per MOCO). Support gem tiers are based on cumulative MOCO sent to other users as support, not on purchases, and are separate from Reward settlement tiers.

P.7 Immediate Delivery and Acknowledgment

Before completing a Purchase, you must accept these terms at checkout. By checking the box and completing payment, you (a) agree to these terms, (b) request immediate delivery of the Package, (c) acknowledge that the Package is delivered in full at the time of payment, and (d) agree that you have no right to cancel the Purchase after payment, except as stated in P.9.

P.8 All Sales Final

Except as stated in P.9, all Purchases are final and non-refundable. This includes, without limitation: change of mind or purchase made by mistake after confirmation; unused MOCO; dissatisfaction with your position, ranking, or visibility on the Contribution Tower; Purchases made without your authorization, including through theft or misuse of a payment method or compromise of your account; MOCO that has been sent in a completed Transfer (see Section X) or used for support or other features; and MOCO that is frozen, cancelled, or forfeited because your account was suspended or terminated for a violation. We do not provide partial refunds, prorated refunds, or substitute credits. The fact that MOCO does not expire does not create a right to a refund.

P.9 Exceptions

We will correct a Purchase or refund the payment only in the following cases: (a) you were charged twice or charged an amount different from the amount shown at checkout; or (b) due to a technical failure on our side, your MOCO was not credited or your Contribution Tower registration was not recorded, and we cannot fix it. Requests must be sent to support@mocomo.net within 30 days of the Purchase. We may ask for information to verify the request. Approved refunds are returned to the original payment method through Stripe. A refund may require us to remove the related MOCO and Contribution Tower entry. If the MOCO has already been used or sent, we may deny the refund or deduct its value from the refund amount. No other refunds are provided.

P.10 Unauthorized Use, Account Compromise, and Minors

Purchases by users under 18 are prohibited. You are responsible for all Purchases made through your account or with your payment method, including Purchases made without your authorization (for example, through theft of a payment method, use of stolen credentials, or compromise of your account). We do not refund such Purchases. Your remedy lies against the person who made the unauthorized use, not against MoCoMo LLC. If you believe your account or payment method has been compromised, contact support@mocomo.net and report the matter to the appropriate authorities. If a Purchase was made by a user under 18, we may suspend or terminate the account and restrict related functions, and the Purchase remains non-refundable.

P.11 Payment Disputes, Chargebacks, and Legal Requests

If there is a problem with a Purchase, please contact us before disputing the payment with your bank or card issuer. If you dispute, reverse, or charge back a payment, you agree that: (a) we may suspend or terminate your account, freeze or cancel any remaining MOCO in your Wallet, and restrict your purchasing, Transfer, support, and payout functions; (b) MOCO already sent in a completed Transfer remains final under Section X; (c) we may submit records to Stripe and the card issuer as evidence, including Purchase and delivery records, IP address, device information, date of birth entries, and records of your acceptance of these terms; and (d) to the extent permitted by law, you are responsible for any dispute fees and reasonable costs we incur. If your account was hacked or your payment credentials were stolen and used, we do not refund or reverse the Purchase. Upon a valid request or legal process from law enforcement or a court, we will suspend the relevant accounts and provide relevant records to assist the investigation.

P.12 MOCO Balance; No Expiration

Purchased MOCO does not expire due to the passage of time or inactivity. Your balance remains subject to these terms, to account suspension or termination as provided in the Terms of Service, and to applicable law, including laws on unclaimed property. If we permanently discontinue the Service, we will give reasonable advance notice.

P.13 Using MOCO

You may use MOCO only on the Service and only for the features we make available, such as Transfers under Section X. In certain features, MOCO is returned to your Wallet in specific cases (for example, when a queued item is cancelled before it plays, as stated in that feature's rules). A return of MOCO to your Wallet is a credit of the same virtual item and not a refund of money. MOCO that you receive through Transfers is separate from MOCO you purchased; payouts for received MOCO, if available, are provided only to eligible adult users through Stripe under the applicable payout terms.

P.14 Fraud Prevention

We may verify Purchases, delay or cancel orders, limit the number or amount of Purchases, and refund payments if we reasonably suspect fraud, abuse, or a violation of these terms or the Terms of Service.

P.15 Web-Only Purchases

MOCO can be purchased only on the Service's website. In-app purchases are not offered in any mobile app, and purchases are not made through any third-party app store or platform. Any mobile app may be used to access features that use MOCO already in your Wallet, but it does not provide a way to purchase MOCO.

P.16 Changes

We may change Package contents, Contribution Tower features, and prices from time to time. Changes apply to future Purchases and do not remove MOCO already credited to your Wallet. We may update these terms and will post the updated version on the Service. Continued Purchases after an update mean you accept it.

P.17 Disclaimer and Limitation of Liability

To the maximum extent permitted by law, the Contribution Tower is provided "as is," and we do not guarantee any particular position, ranking, duration, or visibility. To the maximum extent permitted by law, our total liability for any claim relating to a Purchase is limited to the amount you paid for that Purchase. Nothing in these terms limits liability that cannot be limited under applicable law.

P.18 Governing Law and Disputes

These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Disputes are resolved as provided in the dispute resolution section of the Terms of Service.

Section X: MOCO Transfers

X.1 Transfers

Users may send MOCO to other users on the Service ("Transfer"). Each Transfer is a voluntary gift and support ("Support") from the sender to the recipient.

X.2 Source of Funds

MOCO sent in a Transfer is deducted from the sender's purchased (paid) MOCO balance.

X.3 Final and Non-Refundable

Once a Transfer is completed, it is final. Sent MOCO is treated as Support and cannot be refunded, reversed, or recalled by the sender.

X.4 Prohibited Content

Any message, note, or content attached to a Transfer must not contain profanity, harassment, hate speech, discrimination, sexual or obscene content, threats, defamation, or any unlawful content.

X.5 Legal Responsibility

Senders are solely responsible for the content they send. Violations may result in civil or criminal liability under applicable law. MoCoMo LLC may disclose relevant information to authorities where required by law.

X.6 Enforcement

MoCoMo LLC may, at its discretion, hide or delete violating content, suspend or restrict Transfer functions, freeze or cancel the related MOCO, and suspend or terminate accounts, with or without prior notice. MOCO that is frozen or cancelled due to a violation is not refundable.

X.7 Acceptance

By clicking "Send" to complete a Transfer, the sender confirms that they have read and agree to these Terms, including this Section.

X.8 Eligibility

To use Transfers, users must provide an accurate date of birth. Regardless of country or jurisdiction, only users who are at least 18 years old may send Transfers. Users who are under 18 but otherwise permitted to use the Service may receive Transfers. Users who misrepresent their age are solely responsible for any resulting consequences, and MoCoMo LLC may suspend or terminate their accounts and restrict related functions.
